Published waivers
We normally publish the details of waivers we have given unless we consider it inappropriate or unnecessary to do so.
Chapter 8 of the Supervision manual sets out our approach to waivers. You may view the details of most published waivers through the FSA register.
CAD model waivers are the exception. The FSA's policy is to publish the fact that a CAD model waiver has been granted for a firm but we do not publish the full text of the CAD model waiver direction as it has been deemed inapproate and unnecessary. In particular, this is on the grounds that its publication would prejudice, to an unreasonable degree, the commercial interests of the firms concerned.
We have compiled a consolidated list of waivers that we have approved and published. No notices of CAD waivers granted before November 2002 appear on this list.
Certain types of waivers are not accessible through the Register, but are published separately
- anonymous waivers – where we have given the waiver but have determined that it should be published in way that does not disclose the identity of the firm; and
- deemed scheme waivers – currently, this is where we have given a waiver to the provisions of the FSAVC Review and the Pensions Review.
(Details of these can be accessed above.)
