Mutual Societies

 

  1. The FSA makes relevant public domain documents available and levies charges, by virtue of legislation including S.106 Building Societies Act 1986, S.104 Friendly Societies Act 1992, various provisions in the Industrial and Provident Societies Act 1965, the Friendly Societies Act 1974, the Credit Unions Act 1979 and the Financial Services and Markets Act 2000. These terms and conditions may change without notice in accordance with the above or any other relevant legislation that may apply from time to time and otherwise at the sole discretion of the FSA.
  2. The FSA will make these terms and conditions, together with current scale of charges, available on request. Our charges may change from time to time and although they do not currently attract VAT, in the event that VAT becomes payable for any reason, the appropriate amount will be additional to the current published scale of charges.
  3. The FSA will only accept written orders. Payment for orders is due in advance of any costs being incurred by the FSA. The basic charge for the goods and services required will be made at the time any order is accepted by the FSA. Payment will normally be accepted in the form of a credit or debit card. However, in exceptional circumstances payment by cheque will be considered but this may result in additional time before the order can be completed.
  4. When it becomes apparent that the full cost of any order exceeds the basic charge, the FSA will require payment of the difference before any chargeable work is done.
  5. Orders may be cancelled before any charge in addition to the basic charge is made, but the FSA reserves the right to charge for any costs incurred prior to cancellation over and above work included in basic charges.
  6. An additional charge for postage and packing will be made for each service delivery and is additional to every other charge.
  7. The FSA will endeavour to complete all orders within fifteen working days of the order being accepted and receipt of payment of the basic charge or charges where payment is made by credit or debit card. If the method of payment is by cheque this period may be extended to up to twenty working days. If it is not possible to process the documents requested within the designated period for any reason, including extra work or services being required or a file or part of a file not being available, we will try to notify the client of the delay and, if possible, when completion may be anticipated. Orders may be cancelled if we are not able to meet the reasonable requirements of any client but the FSA reserves the right to retain any payment already received to meet costs associated with the order to date.
  8. The FSA will endeavour to make all public domain information available in accordance with relevant legislation. This may not always be possible, in which case or cases, the FSA does not accept any responsibility whatsoever for any consequences of any delay or failure to make such information available.
  9. In compliance with its duties to make information available to the public, the FSA will only provide such information in written form in the English language or such other language as may be lawfully used by the originator.
  10. The FSA does not accept any responsibility whatsoever for delays occasioned by other suppliers or third parties that are beyond our control. This includes any electrical, electronic or mechanical failures, non-availability of staff or other resources and late delivery by or on behalf of any postal service, courier or other means whatsoever. The FSA reserves the right to make an additional charge, payable by credit or debit card in advance, whenever a client requests delivery by any means other than that normally employed by the FSA or to any address outside the United Kingdom.
  11. When a client requests personal viewing of any public domain record or part of a public domain record, the FSA will determine where and when that facility will be offered at its sole discretion. This will usually be in a public area of our head office at 25 The North Colonnade, Canary Wharf, London, E14 5HS. We will usually offer a number of appointment times when clients may visit our offices for this purpose, between 10am to 12 noon, and 2pm to 4pm, on working days from Monday to Friday inclusive. We will try to agree a mutually convenient appointment within these times and will consider other client needs in exceptional circumstances, but we do not undertake to provide service outside these times. We may not always be able to provide these facilities, and reserve the right to withdraw them or cancel appointments at short notice without reference to clients. When we are not able to offer personal viewing facilities for any reason, the FSA will not be responsible for any consequences whatsoever resulting from the withdrawal of the facilities.
  12. Any client or their agent or any other person or persons whatsoever who avail themselves of any facilities offered by the FSA at any time agrees to abide by any reasonable conditions that may be applied to them by the FSA whilst on FSA premises. Any such person will immediately leave FSA premises on being requested to do so by any member of FSA staff and will promptly comply with any instructions given by any means in the event of fire, security alert or other similar emergency or unusual circumstances.
  13. The FSA operates a No Smoking Policy in all public areas.
  14. The FSA may at its discretion make available other facilities or equipment to visitors to its offices. Visitors agree to use such facilities or equipment for the intended purpose only and to comply with any reasonable requests made concerning the use of any such facilities or equipment and to report any damage or malfunction to FSA staff without delay. The FSA does not accept any liability for any loss or damage arising from the use of any such facilities or equipment.
