  1. FSA003: Capital Adequacy Form - [Data Element 108A].
    The undermentioned guidance is provided in light of a review of the FSA003's so far submitted to the FSA and queries from a couple of firms regarding whether data element 108A should be left blank where a firm has not yet agreed an Individual Capital Guidance (ICG) with the FSA.

    Banks and Building Societies:
    The FSA's view is that Banks and Building Societies should use their interim ICG until a final ICG is agreed. Whilst the FSA has not not written to each bank and building society with an individual figure, we provided a formula which would enable them to calculate this figure. Banks and building societies were asked to confirm to the FSA what the result of this calculation was. If this has not been done and/or a final figure has not been agreed, they should use the formula to calculate their ICG in the interim.

    Investment Firms:
    In the case of investment firms, if an ICG has not been agreed they should leave data element 108A blank.

Important changes to the FSA028 (Non EEA sub-group)

The content of the FSA028 (Non EEA sub-group) is changing and is due to take effect for reporting period end dates 30 June 2008 onwards. The main changes affect the filter questions at the beginning of the data item, which allows a firm to indicate whether it is the lead firm in a non-EEA sub-group, for the purposes of reporting on capital and large exposures.

From 1 July 2008, you will be required to submit the revised FSA028 (Non EEA sub-group) using GABRIELLA until GABRIEL goes live on 26 August 2008.

For reporting period end dates prior to 30 June 2008, you should continue to download the data item from the Early Reporting System (ERS) and continue to submit via the ERS.

What is Early Reporting?

Since January 2007 credit institutions and certain investment firms subject to the new rules under CRD have been required to submit new CRD returns FSA009 (Key Data) and if applicable FSA028 (Non EEA Sub Group) via the ERS system.

From 1 January 2008 the FSA003 (Capital Adequacy) will replace the FSA009 (Key Data). The last reporting period end date for the FSA009 (Key Data) is 31 December 2007. The first reporting period end date for the FSA003 (Capital Adequacy) is 1 January 2008.

In addition, from 1 January 2008 CRD impacted firms will also be required to submit the FSA004 (Credit Risk) and FSA011 (Building Society Liquidity) as applicable.
